按照我国银行业对外开放的承诺，我国银行业将于今年年底全面开放人民币业务，外资银行将更大规模地进入我国市场，这将对我国银行业竞争格局、市场秩序甚至金融安全产生重大影响。然而我国对外资银行监管的法制体系并不完善，外资银行监管工作也面临着新的压力和挑战。研究我国对外资银行监管的法律制度对于保证金融行业的稳定具有极其重要的现实意义。 本文采用比较分析，层层深入的研究方法，从介绍外资银行及其监管制度入手，分析了我国对外资银行监管制度存在的缺陷，进而提出了相应的完善建议。 文章共分为四部分：一、外资银行及其监管概述。简要介绍了外资银行及其监管的概念。然后对外资银行监管的原则以及巴塞尔体制中关于对外资银行监管的要求和内容进行概括。二、我国的现状及我国对外资银行监管的现状分析。三、我国外资银行监管法律制度缺陷分析。指出我国在立法方面、监管机构设立、监管实践方面存在的缺陷。四、完善我国对外资银行监管法律制度的建议。重点论述了我国应加强外资银行监管法律体系的构建；应完善外资银行的监管体系并提出应在监管实践方面改变思维，完善监管手段并加强与外资银行母国及国际监管组织的合作。 关键词：外资银行 监管 法律制度 完善 Abstract According to our country banking industry to foreign countries opening up pledge, our country banking industry will comprehensively open Renminbi service to the end of this year, the foreign capital silver about to large-scale enters our country market, which will have the significant influence on our country banking industry competition pattern and the market order, even finance safely.
